The Disability Discrimination Act 1995 (DDA)

The Act aims to end the discrimination which many disabled people face. This Act gives disabled people rights in the areas of -:
· Employment
· access to goods, facilities and services
· buying or renting land or property.


The DDA is divided up into various parts

Part 1 - Definitions of disability - " a physical or mental impairment which has a substantial and long term adverse effect on his ability to carry out normal day to day activities"

Part 11 - Employment Provision - ( employers with 15 or more employees - it requires employers to consider making changes to their premises)

Part 11 - Duties of Trade Organisations to their disabled members and applicants. -
· by treating him or her less favourably (without justification) than other employees or job applicants because of his or her disability, or
· by not making reasonable adjustments (without justification).

Part 111 - Access to Goods and Services -
· Treating a disabled person less favourably because they are disabled has been unlawful since Dec 1996.
· Since Oct 1996, service providers have had to consider making reasonable adjustments to the way they deliver their services so that disabled people can use them.
· The final stage of the duties, which means service providers may have to consider making permanent physical adjustments to their premises, comes into force in 2004.
